You should read and understand these Conditions because they affect your rights and liabilities. 1. Definitionsa) "Limited Company Limited" means Limited Company Limited, registered in England Company No. 1287877, also referred to as "we" or "us" in these terms and conditions. b) "Force Majeure" means any clause affecting the performance by Limited Company Limited of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party. c) "Working days" means Monday to Friday, excluding Bank or other Public holidays 2. Ordersa) All contracts of sale made by Limited Company Limited shall be deemed to incorporate these terms and conditions, which shall prevail over any other terms from the party ("the Customer") with whom Limited Company Limited is dealing. Cancellation of orders by business-to-business customers is not accepted as many orders are despatched on the same day the order is placed. Cancellation of orders by consumers can only be accepted in accordance with the Consumer Protection (Distance Selling) Regulations 2000. b) All orders are subject to acceptance and to availability of the goods ordered. Limited Company Limited is entitled to refuse any order placed by you. c) You undertake that: 1. all details you provide to us for the purpose of purchasing goods or services offered on our web site are correct and 2. the credit or debit card you use to make a purchase from us is your own or your company's card, that you are authorised to use it, and that there are sufficient funds or credit facilities to cover the cost of any goods or services you order from us. We reserve the right to obtain validation of your credit or debit card details before providing you with any goods or services. 3. Pricesa) All prices are inclusive of VAT (where appropriate) and shipping cost within the UK Mainland and are correct at the time of entering information. b) Limited Company Limited reserves the right to change prices without prior notice. 4. Delivery, Title and Riska) any time or date stated for delivery is an estimate only. Limited Company Limited makes every effort to despatch goods on time, but does not accept liability for failure to deliver within the stated time b) a signature will be required by the Carrier on receipt Goods therefore customers must arrange for receipt of their order. c) If Limited Company Limited is unable to deliver the goods within 30 working days of the date of order, the Customer will, as its sole remedy, be entitled to cancel the order and require any monies paid to Limited Company Limited in respect of that order to be refunded. In order to cancel, the Customer must send written notice of cancellation to Limited Company Limited after the above date, but before delivery of the goods or notification from Limited Company Limited that the goods are ready for delivery. d) Limited Company Limited does not accept liability for shortages or damage to deliveries unless the Customer notifies Limited Company Limited of the shortage or damage in writing within 24 hours of receipt of the delivery. Evidence of broken items to be returned within 7 working days. e) The customer has to accept the goods when they are ready for delivery. f) Delivery is deemed to take place when the goods are delivered to the Customer's nominated address, whereupon the risk of loss, breakage and all damage and all other risks shall pass to the Customer. g) Title in the goods does not pass to the Customer until Limited Company Limited receives payment in full. g) If the customer does not or cannot accept delivery, and the good(s) are returned to Limited Company Limited by it's own carrier who has failed to make good a delivery to the customer the order will be deemed cancelled if the customer fails to re-order within 7 working days. A refund will follow less a £10 handling charge. DESPATCHWe will automatically despatch all approved orders to UK Mainland addresses. We can make individual arrangements and quote the costs according to the circumstances. PAYMENTYou can either pay by credit or debit card (we accept Switch, Delta, Visa, Mastercard, and Solo). We will not deduct any payment from your credit card until such time as we are able to despatch the Goods to you. RETURN POLICYAll Goods and correspondence to be marked "RETURNS" and sent to: RETURNS In addition to your statutory rights, we are pleased to offer a refund (excluding your carriage costs) or exchange on any of our items returned in a saleable condition if returned within 7 days of receipt in the same transit packaging that the goods were dispatched, or in packaging supplied by the customer provided always that such packaging is of a superior protective quality as that the goods were dispatched in. Limited Company Limited must be notified within 24 hours of the fact of Goods received by the customer 'broken in transit' by email and/or telephone (see 'Contact' page on website). The Goods will either be replaced or a refund made upon receipt (by Limited Company Limited) of the returned broken Goods, according to the customer's request. Broken items to be notified within 24 hours and returned within 7 working days.
